General Terms and Conditions for the miju webshop (B2C Business)
1. Scope of Application
1.1. These Terms and Conditions, in the version valid at the time of the order, shall apply to all contracts concluded via our online shop.
1.2. Our online shop is intended exclusively for consumers.
1.3. For Germany: A consumer within the meaning of Section 13 of the German Civil Code (BGB) is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.
1.4. For Austria: In the following terms, the term "consumer" refers to a "consumer" within the meaning of the Austrian Consumer Protection Act (KSchG).
2. Contractual Partner, Conclusion of Contract, and Correction Options

2.2. By placing products in the online shop, we make anon-binding offer to conclude a contract for these items. You may initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. By submitting an order via the order button, you place a legally binding order.
2.3. The contract is only concluded when we accept your order by means of a declaration of acceptance or by delivering the ordered products. Immediately after submitting your order, you will receive a confirmation of receipt of your order by email.
3. Contract Language and Storage of the Contract Text
3.1. The language(s) available for the conclusion of the contract are German and English.
3.2. We store the contract text and will send you the order data and our Terms andConditions in text form. You may view the contract text in your customer login.
4. Delivery Terms
4.1. Shipping Costs
Standard shipping is free of charge for orders with a minimum order value of EUR 100 (including VAT) for customers based in Germany and Austria
4.2. Delivery Options
We ship the products to the delivery address specified during the ordering process.
We deliver by shipping only. Collection of goods by the customer is not possible.
We only deliver to customers whose habitual residence (billing address) is in one of the following countries and who can provide a delivery address in these countries: Germany and Austria.
5. Payment
5.1. Prices
The prices stated at the time of the order shall apply. These are gross prices and include statutory value-added tax (VAT) and are exclusive of any shipping costs.
5.2. Due Date and Default in Payment
The purchase price is due upon conclusion of the contract, unless a later payment date is specified in the following payment terms.
For customers based in Germany and Austria: In the event of payment default, we reserve the right to charge a fee of EUR 1.50 per reminder for the second and each subsequent payment reminder. You are entitled to prove that a lower damage has been incurred. Any further claims remain unaffected.
5.3. Payment Methods
The following payment methods are generally available in our online shop.
Credit Card
During the ordering process, you provide your credit card details. Your card will be charged immediately upon placing the order.
PayPal
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, log in with your access data, and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order has been placed. Further information will be provided during the ordering process.
PayPal may offer additional payment methods in the customer account to registered PayPal customers selected according to its own criteria. We have no influence over the offering of these methods; any additional payment options offered individually relate solely to your legal relationship with PayPal. Further information can be found in yourPayPal account.
Google Pay
To pay the invoice amount via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland (“Google”), you must be registered with Google, have activated Google Pay, log in with your access data, and confirm the payment instruction. The payment transaction is carried out immediately after the order has been placed. Further information will be provided during the ordering process.
Klarna
In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden (“Klarna”), we offer the following payment options. Unless otherwise stated below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. Further information is provided with the respective payment option and during the ordering process.
Purchase on Invoice via Klarna
The invoice amount is due 30 days after shipment of the goods and receipt of the invoice. Payment by invoice is only available to consumers.
Klarna may offer additional payment methods in the customer account to registered Klarna customers selected according to its own criteria. We have no influence over the offering of these methods; any additional payment options offered individually relate solely to your legal relationship with Klarna. Further information can be found in your Klarna account.
Credit Card via Klarna
During the ordering process, you provide your credit card details. Your card will be charged immediately after the order is placed. No address or credit check is carried out.
6. Retention of Title
6.1. The product remains our property until full payment has been received.
7. Warranty and Guarantees
7.1. Liability for Defects
The statutory liability for defects applies.
7.2. Warranties and Customer Service
Information on any additional warranties that may apply and their exact conditions can be found with the respective product and on special information pages in the online shop.
8. Liability
8.1. We shall be fully liable for claims arising from damages caused by us, our legal representatives, or vicarious agents
· in the event of injury to life, body or health,
· in the event of intentional or grossly negligent breach of duty,
· in the event of a warranty promise, where agreed, or
· to the extent that the Product Liability Act applies.
8.2. In the event of a slightly negligent breach of essential contractual obligations, i.e. obligations whose fulfilment is essential for the proper execution of the contract and on whose compliance the contractual partner regularly relies and may rely (so-called cardinal obligations), liability shall be limited to the foreseeable damage typical for such contracts at the time the contract was concluded.
8.3. Otherwise, claims for damages are excluded.
9. Governing Law
9.1. The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you placed the order as a consumer and, at the time of your order, had your habitual residence in another country, the application of mandatory legal provisions of that country shall remain unaffected by the choice of law set out in sentence 1.
9.2. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
9.3. Should individual provisions oft hese Terms and Conditions be wholly or partially invalid, the remainder of the contract shall remain valid. Insofar as individual provisions are invalid, the content of the contract shall be governed by the statutory provisions.
